“According to Article 26 of the Law, a commissioner may be removed from office on various grounds, however, the Law is silent on the process for dismissal. The SCA is of the view that the enabling legislation of an NHRI must contain an independent and objective dismissal process, similar to that accorded to members of other independent State agencies.

The SCA reiterates its 2018 recommendation and encourages the NCHR to advocate for amendments to the Law to ensure an independent and objective dismissal process.

The SCA refers to Paris Principle B.3 and to its General Observation 2.1 on ‘Guarantee of tenure for members of the NHRI decision-making body.”
